By registering with Clave Cuba, you attest that you have read and agree to the program terms and conditions and the responsibility statement as outlined below.
Program rates are guaranteed upon receipt of the deposit for content included in the program description at the time of booking. Activities and services added later are subject to rates in effect at the time they are added. Printed program, activity, and service rates are subject to change without notice.
A non-refundable deposit is due at the time of registration and the full balance is due 120 days prior to arrival. The amount of the deposit is determined on a program basis and documented with the program estimate.
Payment for any additional activities or services added after registration is due with the final payment. Payment in full is due at the time of registration for any programs or activities booked within 120 days of the date of arrival unless otherwise noted in the program documentation. All payments are processed under Clave Travel.
Solo Traveler Cancellations
Travelers can cancel their registration at any time. Cancellations must be made through the website or received in writing to email@example.com. The cancellation will be effective based on the timestamp of the action online or upon receipt of the cancellation email by Clave Cuba.
If the cancellation is effective:
Registration will be considered cancelled by the traveler if payment is not received by the stated deadlines. This includes declined payments not resolved by the payment deadline.
Group cancellations are subject to the same cancellation policy as Solo Travelers. Where individual Travelers on a Group program cancel but the Group as whole does not, Group accommodations and transportation arrangements for the remaining Travelers may be modified to adjust for fewer Travelers.
US Regulatory Changes
If U.S. policy is altered to make it so that the trip is not compliant with U.S. law regarding travel to Cuba, a refund minus any unrecoverable costs will be granted. This will only be the case if there is no legal avenue for travel to Cuba that would allow for the trip to move forward.
Other Reasons Beyond Our Control
Clave Cuba reserves the right to cancel a program prior to departure for reasons beyond its control such as natural disaster, political, economic or social instability, and acts of war, terrorism in the US, Cuba or neighboring countries. In such an event, travelers can transfer the amounts paid to an alternate program or receive a refund. Transferable amounts and refunds will be minus processing fees and any unrecoverable costs.
Clave Cuba also reserves the right to decline to accept any person as a participant in programs, or to require any participant to withdraw from the program at any time, when such an action is determined by a Clave Cuba staff representative to be in the best interests of the health, safety, and general welfare of the program group, or of the individual participant. The participant required to withdraw forfeits all financial or legal claims against Clave Cuba.
Clave Cuba may also refuse service to any applicant, registrant or participant whose behavior or actions are deemed racist, sexist, homophobic, or hostile towards other participants, staff, or Cuban society and culture.
Clave Cuba reserves the right to make changes in the published itineraries whenever, in its sole judgment, conditions so warrant, or if they deem it necessary for the comfort, convenience or safety of the participants.
We make every attempt to maintain the itinerary as published, however Cuba has its challenges and adaptability is key to ensuring that you have the best possible experience.
In the rare event that we are unable to substitute an activity of similar value or confirm lodging that meets our standards, we will assess the difference in value and may decide at our discretion to provide you with a partial refund or a discount on future travel to be used by yourself, friends or family.
No refund or adjustment can be made for any portion of the services not used such as voluntary non-usage of accommodations, scheduled meals, or any planned activity included in your itinerary.
All travelers are required to carry a valid passport and a Cuban tourist card. Those without a valid passport and tourist card will not be allowed entry into Cuba. Your passport should be valid for a minimum of 6 months after the departure date. You may obtain a tourist card from the airline.
Clave Cuba is licensed by the Office of Foreign Assets Control (OFAC) under section 31 C.F.R. §515.572(a)(1) to provide travel services to individuals under US jurisdiction traveling to Cuba. Your trip is designed to comply with U.S. regulations on travel to Cuba as well as local laws in Cuba.
We provide you with a fulls schedule of activities, a certificate of legal travel to Cuba through our Humanitarian Projects licensed under 31 CFR § 515.575 and retain all records on your behalf.
When traveling to Cuba while under US jurisdiction, Clave Cuba is not responsible for violations as a result of travelers ignoring advice, altering programs on the ground, or breaking Cuban law.
All financial transactions are through Clave Travel on behalf of Clave Cuba.
Travel cancellation and trip interruption insurance is not included in program cost. Clave Cuba accepts no responsibility for traveler illness or accidents of any kind prior to or during travel. Travel cancellation and trip interruption insurance policies may refund travel costs because of illness, injury or accidents. If you would like to purchase travel insurance through a third party, we recommend World Nomads.
By registering for a Clave Cuba program, you consent to us using images and video of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes. Any requests for exception must be received in writing prior to your arrival date.
Clave Cuba and Clave Travel serve only to assist in making necessary travel arrangements for its participating members, and in no way represents, or acts as agent for, transportation carriers, hotels, and other suppliers of services connected with this trip. Therefore, is not liable for any injury, damage, loss, accident, delay or other irregularity which may be caused by the defect of any vehicle or the negligence or default of any company or person engaged in performing any of the services involved.
Additionally, responsibility is not accepted for losses or expenses due to sickness, weather, strike, hostilities, wars, natural disasters or other such causes.
All services and accommodations are subject to the laws of the country in which they are provided.
All participants are subject to the laws of the country in which they are visiting. Failure to comply with the laws and regulations of Cuba will relieve Clave Cuba and Clave Travel of all obligations to the participant. Likewise, participants denied entry into to Cuba will have no claim against Clave Cuba and Clave Travel.
Clave Cuba and Clave Travel do not accept liability for any airline cancellation or delay incurred by the purchase of an airline ticket. Baggage and personal effects are the sole responsibility of the owners at all times.
By registering the participant is attesting to having carefully read the schedule of activities for the program. The participant recognizes that there is a moderate to advanced level of physical activity involved in the programs and the program may require participants to walk long distances, climb stairs, and engage in physical activities. The participant accepts any risks thereof and the conditions set forth therein. The participant agrees to release and hold harmless Clave Cuba and Clave Travel and any of their officers or representatives from any and all liability for delays, injuries or death, or for the loss of or damage to, his/her property however occurring during any portion of the program.
